FAQ
Common questions
What is taxed on the purchase of a home: VAT or transfer tax (ITP)?
It depends on who is selling and whether the property is new or second-hand. The first sale of a home by the developer is subject to VAT, at the reduced rate of 10%, and to Stamp Duty (Actos Jurídicos Documentados). The sale of a second-hand home between individuals is subject to Transfer Tax (ITP), at a rate set by each autonomous community.
What is the deadline to file Inheritance and Gift Tax?
For inheritances, six months from the date of death, extendable by a further six months if requested in time. For gifts, thirty business days from the date of the document formalising them.
I have received a tax assessment: can I appeal it, and within what time?
Usually yes. An administrative appeal (recurso de reposición) or an economic-administrative claim must be lodged within one month of the day following notification.
When is it mandatory to negotiate before suing?
Since 3 April 2025, in most civil and commercial matters of a dispositive nature, resorting first to an appropriate dispute resolution method (MASC) is a procedural requirement for the claim to be admitted (art. 5.1 of Organic Law 1/2025).
What is the deadline to challenge a dismissal?
Twenty business days from the effective date of the dismissal. This is a forfeiture period, not a limitation period, so it cannot be interrupted.
Every matter deserves sound judgement.
