Claims against insurers

If your insurer does not pay, or pays less than it should, we claim.

Claim for compensation for an insured loss: analysis of cover and exclusions, assessment of the damage, expert evidence, pre-action claim and lawsuit, with the interest provided for in art. 20 of the Insurance Contract Act.

Claims for breach of contract

If someone breaches a contract with you, we demand performance or compensation.

Action for performance or for termination with damages (art. 1124 of the Civil Code), claims for loss and damage, penalty clauses and guarantees.

Money claims

We recover the money you are owed.

Formal prior demand, order-for-payment procedure (monitorio), oral or ordinary proceedings, interim measures and enforcement of the judgment.

Civil liability

We claim, or defend you, for damage caused to third parties.

Contractual liability (art. 1101 of the Civil Code) and non-contractual liability (art. 1902): proof of damage and causation, valuation and negotiation with insurers.

Civil property proceedings

We resolve property ownership and possession disputes before the courts.

Ownership and possession disputes: actions to recover and to declare title, summary protection of possession, eviction and claims between co-owners.

Drafting and review of contracts

We draft contracts that prevent future problems.

Civil and commercial contracts (sale, loan, works and services), with guarantee, penalty and termination clauses that prevent disputes.

Pre-action negotiation and MASC

Before suing, the law requires an attempt to reach an agreement; we prepare it and document it.

Compliance with the procedural requirement prior to a civil claim (Organic Law 1/2025, in force since 3 April 2025) through negotiation, mediation, conciliation, neutral expert opinion or a confidential binding offer, with documentary proof and effects on costs.

Inheritances and succession

We accept and divide the inheritance, handling every formality.

Acceptance and partition of inheritances, wills and forced shares, with the settlement of Inheritance and Gift Tax.

FAQ

Is it mandatory to attempt a prior settlement before suing?

In the civil courts, as a general rule, yes: since 3 April 2025 a claim is only admitted if a prior attempt at negotiation, mediation, conciliation or another appropriate dispute resolution method is shown (Organic Law 1/2025), except in cases such as the protection of fundamental rights. We prepare it as part of the strategy.

What is the deadline to claim against my insurer?

Actions arising from an insurance contract are time-barred after two years for damage insurance and five years for personal insurance (art. 23 of the Insurance Contract Act). It is advisable to claim as soon as possible to preserve the evidence.
