FAQ
What taxes are paid when buying a home?
It depends on the transaction: the first sale of a new home is subject to VAT and AJD, and a second-hand home to ITP, with some exceptions. VAT and ITP are mutually exclusive (art. 7.5 LITPAJD). We calculate it for your transaction.
Can I use my home as a tourist rental in a building under horizontal property?
The approval of the homeowners’ association is required, with the favourable vote of three fifths of the owners (art. 17.12 LPH, following Organic Law 1/2025), in addition to the responsible declaration in the Andalusian Tourism Registry. The national single registry was annulled by the Supreme Court in 2026 (STS 620/2026).
How long do I have to challenge a resolution of the association?
Three months from the date the resolution is adopted, or one year if it breaches the law or the by-laws (art. 18 LPH). In addition, you must be up to date with payment of community debts or consign them in court.
